Rana's legal adviser stated that he had already been tried on related charges and extraditing him would amount to a violation of the double jeopardy principle. Nonetheless, it was decided by U.S. courts that the charges in India were different, and in May 2023, a U.S. district court sanctioned his extradition. Further appeals ended with the U.S. In January 2025, the Supreme Court rejected his final appeal, so opening the door for his extradition to India.

India's National Investigation Agency (NIA), which has been leading a look into the Mumbai attacks, detained Rana after he arrived in Delhi.
